What...?

I can't call this a "cease and desist" letter, because it's really a "compell and begin" letter.

This letter from Media Rights Technology (which is selling a DRM application) says they are telling Apple, Microsoft and Adobe to stop refusing to use their product.

The argument seems to be... MRT makes a DRM tool which works (and MRT will tell you all about it, I'm sure).

Adobe, Apple and Microsoft aren't using it.

Because they make up a huge slice of the market, they are in violation of the DMCA for not using this "stellar" product to protect people who are being ripped off by violations of copyright; which could have been prevented by said companies paying MRT lots of money for the privilege of bundling this software.

Now it happens I am irked with Nikon and HP, because they installed some program onto my machine, which makes a program I paid for unsuable, unless I allow a third party to install a patch onto my machine, so I'm not all that inclined to support this position.

But the chutzpah, you've gotta love it... a letter which orders them to cease and desist from not doing something.

So what Nikon program did you install, and what is it interferring with?

I installed Capture.

Depending on how you want to look at it, it either interfere's with nothing, or with everything.

If I launch it, the sytem crashes. A quick blue flash, and then the machine is off.

When I restart, I get told it's a known problem, and all I have to do is let some "anti-piracy" firm install something on my machine.

I bet they use PACE.

I had another piece of software install PACE. The main thing I noticed was that my boot time became very long, so I deleted the PACE folder. Fortunately I don't need the software anymore. I resent having to be on-line so that some third party can confirm that I'm running a legit copy.

What're they gonna do, threaten not to sue?

No, they are threatening to sue for the statutory fines under the DMCA, call it 1,000 USD for each copy of Vista, Real Player, Adobe Flash Player, iTunes, and iPod sold since the program was created.

That, or start bundling/installing it with all of those applications/devices.

That's just obnoxious

And since Apple is explicitly not interested much in DRM,,, trying to piss up a rope may be a good analogy.

As a content creator, in a very small way, I'm not entirely against DRM.

But current systems are priced way out of my reach, and do things I really don't want to do. And DRM systems are currently designed for the short-term benefit of big organisations, which have tended to skim the cream off the top before the artists ever see a penny.

They don't even stop the crooks.
