It seems the story is more convolute: Swordsman's claim disputed

To sum up, the DA says the porn wasn't rape, the guy who had his door busted in says he stopped watching it at 2:30 in the morning. The events took place at 11:30.

Not that it matters, but the dialog was in Spanish.

I'd want to hear the tape played at the same volumn while sitting in the downstairs appartment. Just because there's no actual screaming doesn't meant that it wasn't possible for someone to mistake very loud voices, music, or loud laughter as screaming when filtered through the ceiling.

That aside, a 9 hour gap bewteen "reported screaming" and "taking action" seems... odd, unless the the other guy is lying about when he watched the movie. (And why would he bother to do that?) So I can only hyptothesize that our daring-do swordsman thought he heard something and laid awake all night obsessing about it until he worked himself up into taking action. I'd still give him a psyche evalution.
