I fell for the appearance of credibility in the Mashup post I linked to in Obama WTF?!?!!!!

I had the tab open for a couple of days, and it stewed in my head, and I wrote it up.

Too much time dealing, perhaps, with Bush, and all the petty shit he did. Too much of being upset at the shit Obama is pulling*. My problem isn't that I have outrage fatigue, it's that I have too many things to be outraged about.

Mea Culpa.


*I still have to figure out if I can say anything sensible about the 9th circuit [that bastion of uber-liberal justices I keep hearing about] saying there are things about people being reditioned which are such important state secret they aren't even allowed to be have a trial about whether the act of extraordinary rendition is legal... nope. State Secrets you see. The things we might learn; even if all the juicy stuff is sealed, is much to secret. Never mind that it's common knowledge, round the world.

The only thing I can really see it doing, is should there be a favorable ruling for the plaintiffs, Justice would demand, in the abstract; and the Department of, trails for those to ordered it, and took part in it.

That might reach to Bush, and Cheney (we could only hope), and the White House doesn't want that. So they sweep it under the rug with the rubric of State Secrets.

This, does, however put is in violation of the International Convention Against Torture, which demands that all signatories prosecute it. We inserted weasel words (things about torture having to "shock the conscience" which allows for the people drafting the protocols to say, "hey, it's doesn't shock the conscience."), but that doesn't mean other signatories might not, in the absence of the US upholding its treaty obligations, decide to exercise jurisdiction.

There is precedent, Pinochet for one (and Rumsfeld fleeing France). For a different model there is Noriega. Since the US asserts the right to kidnap people from Mexico, we really aren't in much a moral high-ground if someone were to pull an Eichmann, and kidnap Bush/Cheney/Bybee/Yoo, etc, to the Hague.

I guess I figured out what to say about that, after all.
